Under FCA rules, West One Loans is required to classify potential investors as either "retail clients", "professional clients" or "eligible counterparties". We must therefore categorise you before we provide our services to you or discuss any potential investments with you.
West One only has permission to deal with professional clients and cannot deal with retail clients. In order to be able to promote or provide our investment opportunities to you, we must first classify you as a professional client. Under the FCA's rules you have a right to request classification as a retail client. If you exercise this right we will not be able to deal with you.
The FCA's rules provide the highest level of protection for retail customers, requiring regulated firms to provide more information about the services the firm provides and the risks inherent to such services along with requiring the firm to obtain additional consents and give additional notifications.
The FCA's approach to categorising professional clients means greater reliance can be placed on their ability to make their own investment decisions and understand the risks involved. They are therefore afforded fewer regulatory protections.
If you are an entity such as a company, partnership or trustee of a trust of a certain size or status, we may classify you as a professional client as of right. If you are an entity but in our view do not meet these tests, or you are an individual, we will need to be able to classify you as an elective professional client. In this case we will:
